Overview

The long-lived Visa controversy between Kenya and South Africa has finally been resolved by the two heads of state who agreed on a Visa-free visit to South Africa for Kenyans for a period of 90 days annually.

These 90 days may be used either cumulatively or separately. It is considered mutual as South Africans already had access to Visas for free upon arrival in Kenya since 2017 while Kenyans, on the other hand, were required to provide proof of adequate funds and tickets for return flights.

During his two-day state visit to Kenya, President Cyril Ramaphosa of South Africa and his counterpart president William Ruto of Kenya announced this new agreement which is set to take effect from the first of January, 2023. The agreement came after Kenyans had expressed how difficult it was for them to travel to South Africa with the high cost of South African Visas and the five-day waiting period.

The two countries also came up with a return policy so as to avoid bad elements that may use this opportunity to infiltrate the borders, making sure that they are resolutely and firmly dealt with.

The agreement has also allowed Kenyan students in South Africa to be able to renew their stays whilst in South Africa rather than having to go back home to do the same. As long as they do not leave the airport, Kenyans are now also allowed to transit through South Africa.

An agreement on a sustainable mechanism to address the trade barriers which limit the trade potential between the two countries was also reached, bearing in mind that they are among the strongest economies in the region.

However, as expected, there is a catch! Kenyans who overstay their welcome in South Africa will be deported at the expense of their home country. According to president Ramaphosa, “this will mean that the travel filters between the two countries will be stringent, sieving out illegal immigrants, criminal suspects, and all those taking advantage of the system without paperwork.”
